The contract for using Absolute Stays — the marketplace for homes and experiences in Azerbaijan.

These terms

These Absolute Stays Terms of Service (“Terms”) are a contract between you and Absolute Azerbaijan LLC (Absolute Azerbaijan MMC), VÖEN 2304092521, D.Aliyeva 156, Baku, AZ1000, Republic of Azerbaijan. They govern use of the Absolute Stays website and related services for homestays, beach stays, and experiences in Azerbaijan.

By creating an account, listing a stay, requesting or confirming a booking, or otherwise using Absolute Stays, you agree to these Terms, the Privacy Policy, the Cancellation policy, the Accessibility policy, and any other Stays policy we publish and link from the service. Absolute Creators is also governed by the Creator terms. Hotel software and company products outside /stays/ remain under the Absolute Azerbaijan Terms of Service.

If you use Absolute Stays for an organisation, you confirm you have authority to bind that organisation.

Absolute Stays is a platform

Absolute Stays is an online marketplace. It lets guests discover and book stays and experiences, and lets hosts offer them. Except where Absolute itself operates a listing (for example certain Direct Host or managed homes), Absolute is not the owner of the property, not a real-estate broker, not a tour operator, and not a party to the contract between guest and host for the stay or experience.

The host is responsible for the listing, the property or activity, local permits, safety, cleanliness, and delivering what was described. The guest is responsible for using the stay as booked, following house rules, and paying the amounts shown at checkout. Absolute provides the booking tools, payments collection as described below, messaging, AbsoluteCover where it applies, and customer support.

Absolute does not guarantee that any listing will be available, that any search ranking will continue, or that a host or guest will perform. Rankings consider relevance, quality, availability, and similar signals; they may include paid or programme placement when we disclose it.

Eligibility, accounts, and verification

You must be at least 18 years old to create an account or make a booking. You must provide accurate information and keep it current. You are responsible for activity on your account. Notify us at info@abaz.az if you believe it was used without permission.

We may require identity verification, including SIMA or other government-backed checks in Azerbaijan, before you book, host, or receive a payout. We may refuse, suspend, or limit an account where we reasonably believe there is fraud, safety risk, legal risk, or a breach of these Terms.

One person should keep one guest account unless we approve otherwise. Host tools may be used by the people the host authorises; the host remains responsible.

Your content

You keep ownership of photos, text, and other content you submit. You grant Absolute a worldwide, non-exclusive, royalty-free licence to host, display, translate, crop, and distribute that content on Absolute Stays and in marketing that promotes the listing or Absolute Stays, for as long as the content remains on the service and for a reasonable archive period after removal.

You represent that you have the rights to the content, that it is accurate and not misleading, and that it does not infringe others’ rights. We may remove content that violates these Terms or the law. Reviews must reflect a genuine stay or experience; we may hide or remove reviews that are fake, off-topic, or abusive.

Terms for guests

A booking request is an offer. It becomes a reservation when the host accepts or when the listing is set to instant book and payment is authorised, as shown at checkout. You agree to pay the total displayed, including the stay or experience price, cleaning (if shown), the Absolute Stays guest programme fee (currently 15% of the accommodation or experience subtotal unless a different fee is shown), optional extras, and applicable taxes.

You agree to occupy only the dates and guest count you booked, to follow house rules and the Accessibility policy rules on service animals, and not to use the stay for parties, commercial filming, or other uses the listing forbids without the host’s written agreement. You are responsible for damage beyond ordinary wear that you or your party cause.

Do not take bookings, payments, or contact off Absolute Stays in order to avoid fees. Off-platform booking or payment may lead to cancellation without refund and account suspension.

Experiences are activities with a host or operator. Participate only if the activity is suitable for you. Follow safety briefings. Experience cancellations generally follow the Cancellation policy as it applies to experiences.

Terms for hosts

You must have the legal right to offer the stay or experience. You are responsible for permits, building and tourist rules, safety equipment, accurate calendars, truthful photos and descriptions, and taxes that apply to you as a host in Azerbaijan or elsewhere.

You set the listing price that guests see as the nightly (or experience) rate. Payouts are made in AZN according to the schedule and method we confirm with you, minus any host fees, chargebacks, or amounts we are entitled to withhold under these Terms or your host agreement. Direct Host and other programmes may have additional written terms; Hosting resources explains how hosting works in practice.

You must honour confirmed reservations, keep the calendar accurate, and reply to guests in a reasonable time. Host cancellations outside the Cancellation policy may result in penalties, blocked dates, payout holds, or removal from Absolute Stays.

You must not discriminate against guests on grounds prohibited by Azerbaijani law or by the Accessibility policy. You must not ask guests to pay outside Absolute Stays.

Fees, taxes, and payments

Prices are displayed in AZN. The guest programme fee and any other charges are shown before you pay. Payment is collected by Absolute or its payment partners as a limited payment collection agent for the host, so that a payment to Absolute for a confirmed booking generally discharges the guest’s payment obligation to the host for that booking amount.

Hosts receive the listing amounts Absolute agrees to pay them, not the guest programme fee. AbsoluteCover is included with eligible bookings as described on AbsoluteCover for guests; it is not travel insurance and is not a substitute for the Cancellation policy.

You are responsible for any taxes on your own income. Absolute may issue invoices or reports for platform fees. Gift cards follow the rules on the gift-card page.

If a payment fails, is reversed, or is suspected of fraud, we may cancel the reservation, withhold payout, and recover amounts by invoice or later bookings.

Cancellations, refunds, and major events

Cancellations and refunds follow the Cancellation policy, including the 24-hour guest grace period for home bookings where it applies, the listing’s cancellation terms, host-cancel rules, and rare Major Disruptive Events. AbsoluteCover may help with serious problems with the stay itself; it does not replace the cancellation policy.

We may investigate and take action including removing listings, cancelling bookings, withholding funds, and reporting to authorities.

AbsoluteCover and Creators

AbsoluteCover and AbsoluteCover for guests describe included protection for eligible stays. Cover is a programme benefit, not an insurance policy. Decisions on covered incidents are made by Absolute according to those pages.

If you join Absolute Creators, the Creator terms apply to commissions, unique URLs, and programme rules. Those terms sit on top of these Terms.

Suspension and termination

You may stop using Absolute Stays at any time. We may suspend or end access, remove listings, or cancel bookings where we reasonably believe it is needed to protect users, to comply with law, or because of a material breach. Outstanding payments, licences to content already used in marketing, and sections that by nature should survive (including liability, indemnity, and governing law) continue after termination.

Disclaimers

Absolute Stays is provided “as is” and “as available”. To the fullest extent permitted by Azerbaijani law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that listings are accurate, that hosts or guests will perform, or that the service will be uninterrupted or error-free. You use maps, third-party links, and host-provided information at your own judgement.

Nothing in these Terms excludes liability that Azerbaijani law does not allow to be excluded, including liability for fraud or for death or personal injury caused by negligence where such a limit is not permitted.

Limitation of liability

To the fullest extent permitted by law, Absolute Azerbaijan LLC and its directors, staff, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost bookings, or lost data, arising from Absolute Stays or these Terms, whether in contract, tort, or otherwise.

Except for liability that cannot be limited, our total liability arising out of Absolute Stays or these Terms is limited to the greater of (a) the amounts you paid to Absolute in platform or guest fees for the booking giving rise to the claim in the twelve months before the claim, and (b) 200 AZN.

Hosts and guests remain responsible to each other for the stay or experience. AbsoluteCover, where it applies, is the extra help we choose to provide under its rules — not an expansion of this liability cap except as those rules expressly state.

Indemnity

You will defend and indemnify Absolute Azerbaijan LLC and its staff against claims, damages, and reasonable legal costs arising from your listing, your stay or experience, your content, your breach of these Terms, or your violation of law or third-party rights, except to the extent caused by Absolute’s wilful misconduct.

Governing law and disputes

These Terms and any dispute arising from Absolute Stays are governed by the laws of the Republic of Azerbaijan, without regard to conflict-of-law rules. The courts of Baku have exclusive jurisdiction, except that either party may seek interim relief in any court of competent jurisdiction.

Nothing in this section limits mandatory consumer protections that cannot be waived under the law of your country of residence if that law applies to you as a consumer.

These Terms are issued in English, Azerbaijani, and Russian. If there is a conflict, the Azerbaijani text is the legally governing version for users in the Republic of Azerbaijan.

Changes to these Terms

We may update these Terms. We will change the “last updated” date and, for material changes, give additional notice (for example email or a notice on Absolute Stays). If you continue to use Absolute Stays after the effective date, you accept the updated Terms. If you do not agree, stop using the service. Confirmed bookings keep the cancellation and price terms shown when they were made, unless a policy that existed at booking says otherwise.
